Transport conditions

The place of performance for the Seller is the location where the goods are unloaded. This does not apply in cases where transport is not provided by the Seller—in such cases, the place of performance is where the goods are loaded. These rules also apply to the time of performance.

If transport is agreed to be carried out by the Seller, the Seller is obliged to deliver the goods to the agreed location, without unloading, and only if the access road is suitable for heavy transport.

When the Seller delivers the goods, the benefits and burdens of the goods and the risk of accidental loss or damage pass to the Buyer.
4.
The agreed delivery dates are binding for the Seller only if confirmed in writing.
5.
The Buyer is obliged to unload the goods immediately and professionally, no later than within 2 hours of arrival. The Buyer bears the unloading costs. If unloading is delayed beyond 2 hours, the Buyer shall also bear demurrage charges for the vehicle and driver.

The Buyer has the right to designate an additional unloading location. If this results in a longer route or significant increase in transport costs, the Buyer shall bear the additional expenses.
7.
In all cases, the Buyer is responsible for costs related to unloading delays and any resulting damages to the Seller.
8.
If the Buyer arranges transport independently, the Buyer is responsible for insuring the goods against transport damage or loss.
9.
Freight costs are non-binding. Prices are based on current rates at the time of quotation. Subsequent changes will be charged or refunded accordingly.
10.
The Buyer shall also bear the costs of packaging for transport, including packaging materials and pallets, as well as any costs associated with securing and protecting the shipment.
11.
Any costs or losses resulting from an unjustified refusal to accept delivery, including additional transport and risk costs, shall be borne by the Buyer.
12.
Returns are only possible if the Seller has confirmed the acceptance terms for the returned goods.
13.
If the Buyer changes the place or date of delivery after the order has been confirmed, they shall bear all resulting costs.
14.
The Buyer must immediately check the shipment upon delivery and report any shortages or damage caused during transport.
15.
The Seller authorizes the Buyer—and the Buyer agrees—to handle all formalities related to claims for transport damage. The Buyer must request that the carrier notes the damage on the consignment note or issues a damage report upon receipt; otherwise, any claims for damages will be forfeited.
16.
Extraordinary and unforeseeable events beyond the Seller’s control (force majeure) release the Seller from the obligation to meet delivery deadlines for the duration of such events.
17.
Force majeure includes, but is not limited to, labor disputes (including those involving the Seller’s employees), strikes, disruptions at the supplier’s facilities not attributable to the Seller, transportation disruptions, or government actions preventing contract execution.
18.
General transport terms are outlined in the price lists. Delivery costs based on delivery group:
Delivery Group A – Orders over PLN 4,000.00 net: free delivery
Delivery Group B – Charged individually according to cost calculation
